How to Prevent Abortion?
“Abortion in European Law: Human Rights, Social Rights and the New Cultural Trend” is a new legal study published by Grégor Puppinck, PhD, Director of the ECLJ, addresses the social and economic aspects of abortion in the contemporary context.
The objective of this article is to provide legal means for analysis and action to legislators and organizations wishing to defend women and children against abortion.
Based on accurate and objective analysis of international law, the study shows that there is no “human right to abortion”, but rather that abortion on demand finds no justification regarding to human rights. This study demonstrates that the claim that abortion is a human right is false.
Beyond the purely legal question, this study analyses the issue of abortion in terms of social rights. Indeed, abortion is primarily a social reality which has its causes in the living conditions. It appears that most abortions performed actually originate from social constraints such as employment, housing or studies. However, this is precisely the purpose of social rights: to protect people of such constraints, especially women and families.
It thus appears that respect for social rights guaranteed by European and international law can be claimed as a public means for preventing abortion.
More generally, the aim of this study is to invite legislators to develop a policy to prevent abortion by more supporting women and families.
Finally, this study shows that such an approach already exists in several European countries.
